Terms of service

The agreement between you and us. Written to be read, not to be got past.

Last updated 27th of September 2026 · Version 1.0

1. Who these terms are between

These terms are between you — the business subscribing — and SOMMIE LLC, registered at 30 N Gould Street, Sheridan, WY 82801. By creating an account, ringing our demo line, or letting Tinsley answer your calls, you accept them.

These are business-to-business terms. If you are a consumer rather than a business, this service is not offered to you.

2. What the service is

Tinsley answers your inbound phone calls with an automated assistant called Tinsley. She works out what the caller needs, can book appointments into a connected calendar, sends confirmations, and gives you a summary of what happened.

3. Your account

You must give accurate details and keep them up to date. You are responsible for what happens under your account and for keeping your login secure. Tell us promptly if you think someone else has access.

You must own or be authorised to use the phone number you point at us, and you are responsible for configuring the divert correctly.

4. Plans, minutes and payment

Plans are sold by the minute. A plan includes a monthly allowance:

PlanIncluded minutesPrice
Starter250$49 / month
Professional500 $99 / month
Multi-crew1,000$199 / month

Minutes are counted on connected call time, Call times are always rounded up to the next full 60-second mark. Minutes reset at the start of each billing month and do not roll over.

Calls beyond your allowance are charged at 0.09 per minute, billed in arrears on your next monthly invoice. We'll email you when you pass 80% of your allowance.".

Fees are stated exclusive of VAT, GST and any applicable sales tax, which we will add where we are required to. Payment is taken monthly in advance by the method you give us. If a payment fails we will retry and tell you; if it stays unpaid for 7 days we may suspend the service.

Founding prices

If you joined on a founding price, that price is held for twelve months from the day you first subscribe, provided your subscription stays active. We mean this. If you cancel and come back, the then-current price applies.

5. Cancelling

You can cancel at any time from your account. Cancellation takes effect at the end of the billing month you have already paid for. We do not refund part-months, and we do not charge an exit fee.

On cancellation, calls stop being answered as soon as the period ends — so remember to turn off your divert, or your callers will reach nothing. You can export your call records for 30 days after cancellation, after which we delete them.

6. What you must not do

  • Use the service for anything unlawful, or to harass or defraud
  • Point numbers at us that you are not entitled to use
  • Use it for outbound telemarketing, automated dialling, or any outbound campaign. The service is for inbound calls only
  • Present Tinsley as a human being, or remove or interfere with the disclosure she gives at the start of a call
  • Resell or white-label the service without our written agreement
  • Attempt to overload, reverse engineer, or extract the underlying models
  • Use it for emergency services, or as any part of a system people rely on to summon help

We may suspend an account immediately for a serious breach of this section, and will tell you why.

7. What Tinsley is, and is not

Tinsley is an automated assistant. She will sometimes mishear, misunderstand, or get something wrong. She is not a substitute for your judgement, and she is not a qualified professional in your trade.

In particular:

  • She does not give professional, technical, legal, medical or safety advice, and you must not configure her to
  • Any price or availability she gives is indicative unless you have configured a fixed one, and it is your responsibility to check what she is configured to say
  • She is not an emergency service. If a caller has an emergency, she is configured to direct them to the emergency services, and you must not rely on her to summon help
  • You are responsible for reviewing how she is set up for your business — your services, prices, hours and the way she triages urgent calls

8. Calls, recording and the law

The service records and transcribes calls in order to function. That is not optional; it is how the assistant works.

Tinsley states at the start of every call that she is automated and that the call is recorded. You must not disable or alter that disclosure. It is what keeps both of us on the right side of call recording and AI disclosure rules, which differ by country and by US state.

You are responsible for your own obligations to your callers, including any notice or consent your regulator requires, and for anything you do with the recordings and transcripts after we give them to you.

9. Your data and your callers' data

You own your account data and your call records. We do not sell them and we do not share them with anyone else's marketing.

For anything your callers say to Tinsley, you are the data controller and we are your processor. We handle it on your instructions, under the data processing agreement that forms part of these terms. If one of your callers asks us to delete or hand over their information, we will point them to you and help you answer.

We do not use your call recordings or transcripts to train AI models, ours or anyone else's.

How we handle information is set out in our privacy notice.

10. Availability

We aim to keep the service running continuously, but we do not promise it will never be unavailable. Phone networks, our suppliers and our own systems can all fail.

We don't currently offer a contractual uptime guarantee. We aim for continuous availability and publish incidents as they happen

We will give reasonable notice of planned maintenance where we can. You should keep your own fallback in mind — if the service is down and your divert is on, calls may not be answered.

11. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Subject to that, we are not liable for lost profits, lost business, lost bookings, lost revenue, lost goodwill, or any indirect or consequential loss — including work you did not win because a call was missed, mishandled, or misrouted.

Our total liability in any twelve-month period is limited to the total fees you paid us in the twelve months before the claim".

You agree to indemnify us against claims arising from how you configured the service, what you told us to say, or your own breach of these terms.

12. The demo line

Our demo line is provided for evaluation. It is recorded, it may be changed or withdrawn at any time, and nothing said on it forms part of any agreement. Do not use it for real customer calls and do not give the number to your customers.

13. Changes to these terms

We may change these terms. For material changes we will give you at least 30 days' notice by email, and you can cancel before they take effect if you do not agree.

We may change prices at renewal with the same notice — except where a founding price applies, which is held as set out in section 4.

14. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

If part of these terms turns out to be unenforceable, the rest still stands.
